The Azerbaijani Parliament has adopted in the third reading the rules for releasing foreigners and stateless persons who were forcibly placed in detention centers for illegal migrants, according to the draft law on amendments to the Migration Code, which was submitted for discussion at today’s plenary session of the parliament, Report informs.
According to the draft law, the period of stay for foreigners and stateless persons in the center will be calculated from the moment of their admission in accordance with the decision on their placement in the facility. The issue of extending the detention period or releasing such persons must be resolved before the expiration of the period specified in this decision.
The center’s head must notify the relevant executive authority verbally or in writing 1 working day before the expiration of a person’s placement period in the center. Except for cases of extension of detention based on a court decision, the decision to extend the detention period or release foreigners and stateless persons will be made by the relevant executive authority. Furthermore, the decision to extend the stay or release persons held in the center must be executed immediately upon its receipt by the center.
